Summary: These Sales Terms govern every order placed on GRA GRAMP. They sit alongside our Terms of Service and apply automatically when you complete checkout.
1. Scope of These Sales Terms
These Sales Terms govern every individual purchase transaction made on GRA GRAMP ("gragramp.com," "we," "us," or "the platform"). They are supplementary to, and incorporated by reference into, our Terms of Service. In the event of a conflict between these Sales Terms and the Terms of Service with respect to a specific transaction, these Sales Terms control.
By placing an order, you (the "Buyer") and the listing's seller (the "Seller") agree to be bound by these terms. These terms apply to listings priced in USD, EUR, GBP, or any other currency supported on the platform.
2. Marketplace Role; GraGramp as a Seller
GRA GRAMP operates as a marketplace platform that facilitates transactions between independent Buyers and Sellers. For most listings, the contract of sale is formed directly between the Buyer and the third-party Seller; GRA GRAMP is not a party to that sale.
GRA GRAMP also operates its own first-party seller account on the platform under the name "GraGramp" (or affiliated brand names). When a listing is sold by GRA GRAMP itself, GRA GRAMP is the Seller for that transaction and the Buyer's contract is directly with us. The seller identity for every listing is shown on the listing page.
Regardless of who the Seller is, all transactions on the platform are subject to these Sales Terms and our Buyer Protection program (Section 7).
3. Listings, Pricing, and Currency
Sellers are responsible for the accuracy of every listing they publish, including title, description, condition, photos, quantity, shipping terms, and price.
The price displayed on the listing at the time the Buyer completes checkout is the price that applies to the order. Once an order is placed, the price is locked for that transaction; subsequent price changes on the listing do not affect placed orders.
All prices are stated exclusive of any applicable sales tax, VAT, customs duties, or import fees, unless explicitly noted. The Buyer is responsible for any taxes or duties levied at delivery in the destination country.
GRA GRAMP may correct obvious pricing errors (e.g., a $1,000 item listed for $10) before shipment by canceling the affected order and issuing a full refund.
4. Order Formation and Acceptance
An order is formed in two steps:
• Buyer submits an order at checkout and authorizes payment.
• The Seller (or GRA GRAMP, on the Seller's behalf for fulfillment) accepts the order by confirming payment and beginning fulfillment.
Until the order is accepted, the Seller may decline the order — for example, if the item is out of stock, the buyer's address is in an unsupported region, or the listing contained an error. In that case the Buyer's payment is fully refunded and no contract of sale is formed.
For auction listings, an accepted high bid at auction close constitutes the Buyer's commitment to purchase, subject to the Seller's invoice and Buyer's completion of payment within the time stated on the auction.
5. Payment
Payments are processed through GRA GRAMP's secure payment system. Accepted methods at checkout include credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, bank transfer, and any other method displayed at the time of checkout.
The Buyer authorizes GRA GRAMP to charge the selected payment method for the full order amount, including any shipping charges and applicable taxes shown at checkout.
For card and wallet payments, the Buyer's payment is captured at order placement and held under Buyer Protection. For bank transfer or mail-order payments, the order moves to "active" only after the funds are received and verified.
6. Shipping, Delivery, and Tracking
Sellers are required to ship items within 3 business days of the order becoming active (i.e., once payment is confirmed), unless a longer handling time is clearly stated in the listing.
Where a Seller cannot ship within the stated timeframe, the Seller must notify the Buyer through the platform and offer either a revised shipping date or a full refund. This obligation reflects the buyer-protection standard set by the U.S. Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), which we apply to all U.S. orders.
All shipments must be sent with valid carrier tracking (USPS, UPS, FedEx, DHL, or equivalent). Tracking information is uploaded to the platform and shared with the Buyer automatically.
Risk of loss passes to the Buyer when the carrier marks the parcel as delivered. Delivery is tracked through carrier webhooks; the timestamp recorded by the carrier is authoritative for the purpose of starting the inspection window described in Section 8.
7. Buyer Protection
Every order on GRA GRAMP is covered by our Buyer Protection program at no extra charge.
When the Buyer pays for an order, the funds are held by GRA GRAMP and are not released to the Seller until the transaction is complete. Funds are released to the Seller only when one of the following occurs:
• The Buyer confirms receipt and that the item matches the listing; or
• The 3-day inspection window described in Section 8 expires without a dispute being opened.
If the Buyer opens a valid dispute within the inspection window, funds remain held by GRA GRAMP until the dispute is resolved.
Buyer Protection is not an insurance product, and it does not extend to:
• Items damaged by the Buyer after delivery;
• Buyer's remorse where the item matches the listing description;
• Loss or damage occurring after the carrier confirms delivery, unless reported within the inspection window;
• Transactions completed off-platform in violation of these Sales Terms.
8. Inspection Window, Disputes, and Returns
The Buyer has 3 calendar days from the carrier-confirmed delivery date to inspect the item and, if necessary, open a dispute. Disputes are opened from the order page on the platform and must include photographic evidence and a written description of the issue.
Valid dispute grounds include:
• The item is materially different from the listing (wrong model, wrong condition, missing parts);
• The item is damaged on arrival;
• The item is counterfeit or has had its authenticity misrepresented;
• The item never arrived despite the carrier marking it delivered.
GRA GRAMP reviews each dispute and issues a final decision, which may be (a) a full or partial refund to the Buyer, (b) release of funds to the Seller, or (c) a return-and-refund flow with the Seller paying or sharing return shipping. Decisions made by GRA GRAMP under the Buyer Protection program are binding on both parties for the purposes of release of held funds.
For complete details on returns, return windows for matching-description items, and refund methods, see our Returns & Refunds policy.
9. Cancellations
Buyer-initiated cancellation: Buyers may cancel an order before it has been marked shipped by the Seller. Cancellation requests after shipment are treated as a return under Section 8.
Seller-initiated cancellation: Sellers may cancel before shipment if the item is unavailable, damaged in storage, mis-listed, or if the Seller cannot meet the stated handling time. Cancellation results in a full refund to the Buyer.
Auction sales may not be canceled by the Buyer once the auction has closed and the Buyer is the high bidder, except where the Seller agrees or where these Sales Terms or applicable law permit.
10. Off-Platform Transactions
All payments and communications related to a listing must remain on GRA GRAMP. Buyers and Sellers may not arrange off-platform payment, shipment, or delivery for an item discovered through the platform.
Off-platform transactions are not eligible for Buyer Protection, dispute resolution, or any other protection offered by GRA GRAMP, and may result in account suspension for both parties.
11. Fees and Commissions
Buyers do not pay any platform fee on top of the listing price (other than shipping and applicable taxes shown at checkout).
Sellers pay a commission on completed sales, deducted automatically from seller payouts at the time funds are released. The applicable commission rate is shown to Sellers in their seller dashboard and on the order page before listing. Commissions, where deducted, are non-refundable except where the entire order is refunded to the Buyer.
12. Consumer Rights and Statutory Protections
Nothing in these Sales Terms limits any non-waivable consumer rights granted to the Buyer under U.S. federal or state law, including the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), state consumer-protection statutes, the Magnuson-Moss Warranty Act, or any applicable implied warranty under the Uniform Commercial Code.
Where these Sales Terms attempt to disclaim, limit, or waive a right that cannot be disclaimed, limited, or waived under the law applicable to the Buyer, the relevant clause shall be read as narrowly as needed to comply with that law, and the remainder of these Sales Terms shall remain in full force.
13. Governing Law and Dispute Resolution
These Sales Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles, except as required by mandatory consumer-protection laws of the Buyer's place of residence.
The Buyer first must use the platform's internal dispute resolution process described in Section 8 before pursuing any external remedy. Any dispute that remains unresolved after that process is subject to the dispute-resolution and arbitration provisions of our Terms of Service, which are incorporated here by reference.
14. Changes to These Sales Terms
We may update these Sales Terms from time to time. The version in effect at the time the Buyer places an order is the version that applies to that order. Material changes will be communicated through email or a prominent notice on the platform.
